The following terms and conditions are a part of the confirmation of work to be performed by Grand Rapids Snow & Ice Control LLC and with the information on the front, constitute the entire agreement.

PERMISSION
This contract must be signed by the owner/occupant giving Grand Rapids Snow & Ice Control LLC, or representative thereof, permission to enter upon said property. If accepted, the property owner/occupant agrees to hold Grand Rapids Snow & Ice Control LLC and any representatives thereof, to include service vehicles, harmless from any and all claims made for injuries and damages as a direct or indirect result of services provided.

PERFORMANCE
Work crews will arrive at the job site unannounced unless otherwise noted herein. Grand Rapids Snow & Ice Control LLC shall attempt to meet all performance dates, but shall not be liable for damages due to delays for inclement weather or other causes beyond its control. Good faith effort will be made to have work completed before arrival of employees for businesses to ensure a clear lot. Plowing will generally be done between 12:00 A.M. and 6:00 A.M. Unless otherwise specified, plowing begins after 2” of snowfall and maintenance plowing is done as agreed upon on the front side of this contract. If salt spreading is within the scope of work, Customer agrees to release Grand Rapids Snow & Ice Control LLC and its agents and employees from damages caused by delivery and execution of contracted services.

OWNERSHIP
The customer warrants that all property upon which work is to be performed are either owned by the customer, or that permission for the work has been obtained from the owner. Grand Rapids Snow & Ice Control LLC is to be held harmless from all claims for damages resulting from the customer's failure to obtain such permission.

TERMS OF PAYMENT
All statements will be sent out on the 1st and the 16th of the month. Balances are due upon receipt of statement. A $10.00 late fee will be added to all unpaid balances if payment is not received by the next billing cycle. Services will be suspended for accounts that have not been paid 30 days after the invoice date and a service charge of 1 1/2% per month, which is an annual percentage rate of 18%, will be added to the outstanding balance. If outside assistance is used to collect the account, the customer is responsible for all costs associated with the collection including, but not limited to, attorney fees and court costs.

PERMITS
Customer shall obtain and pay for all required permits.

PROPERTY LINES & RESTRICTIONS
Customer shall indicate to Grand Rapids Snow & Ice Control LLC the corners of the property, and shall assume all responsibility for accuracy of markers. Customer shall give a copy to Grand Rapids Snow & Ice Control LLC of any restrictions, easements, or rights of way prior to commencement of services. If such information is not provided, Grand Rapids Snow & Ice Control LLC reserves the right to delay services without compensation to the customer until such time as the information has been furnished.

CONCEALED OBSTRUCTIONS
Property owners are responsible for clearly marking obstructions such as drain lines, speedbumps, fire hydrants, and outdoor lawn decorations, as well as driveway and sidewalk edges. Every attempt should be made to remove all obstacles which may hinder services being provided. Customer represents that they have no knowledge of any concealed obstructions other than those, if any, set forth on the face page of this Agreement as a special instruction. Grand Rapids Snow & Ice Control LLC shall not be held responsible for damage to concealed obstructions or lawns when drive edges are not properly marked.

ACCESS TO WORK
Customer shall provide free access to work areas for Grand Rapids Snow & Ice Control LLC employees and vehicles. Driveways/entrances/parking lots should be clear of vehicles when possible to provide adequate room for service vehicles. Any areas not clear of vehicles or other obstructions may, at driver's discretion, be denied service until they have been cleared. In the event an area is skipped due to inaccessibility, the customer agrees to be billed the normal rate as determined by Grand Rapids Snow & Ice Control LLC. Where applicable, tree limbs and other brush must be trimmed to a height of 10 feet from the drive surface. This service will be offered at an additional cost. Gates, when involving routine service, must be left open or owner/occupant must provide key/codes for access during service season.

ADDITIONAL SERVICES
Customer agrees to pay Grand Rapids Snow & Ice Control LLC on a time and materials basis for any additional work required to complete the job that is not described on the face of this Agreement, or any other condition not apparent in estimating the work specified. If, due to a heavy or frequent snowfall, the areas in which snow to be piled become too full, equipment may be needed to relocate or remove snow so services can continue as contracted. Grand Rapids Snow & Ice Control LLC reserves the right to determine the machines or equipment necessary to provide services requested by owner/occupant in such instances.
